QualityEBiz.com reserves the right to suspend or cancel any customer's access to any/all services provided by QualityEBiz.com when QualityEBiz.com decides that the account has been inappropriately used or its activity could damage any QualityEBiz.com's service. Acceptable Use Policy QualityEBiz.com does not actively monitor nor does QualityEBiz.com exercise editorial control over the content of any web site, electronic mail (e-mail) transmission, mailing list, newsgroups or other material created or accessible over QualityEBiz.com services. However, QualityEBiz.com reserves the right to remove any materials that, in QualityEBiz.com's sole discretion, are potentially illegal, may subject QualityEBiz.com to liability, or violate this Acceptable Use Policy ("Policy"). Your violating this Policy may result in the suspension or cancellation of your QualityEBiz.com services. Use of QualityEBiz.com constitutes acceptance of these terms and conditions. System Performance QualityEBiz.com servers may be used only for lawful purposes. Transmission, distribution, or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, indecent, defamatory, constitutes an illegal threat, or violates export control laws. System and Network Security Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples of system or network security violations include, but are not limited to, the following: Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network. Users who violate systems or network security may incur criminal or civil liability. Customers are liable for having unsecured services, and would be held liable if unknown 3rd parties utilize these services at any time. It is the customer's responsibility to monitor these services. Examples of unsecured services would be use of SMTP relay, incorrect configuration of Proxy or SOCKS services or unsecured operating systems. Customers are responsible for configuring their services to prevent the disruption of service to other customers. (PC Anywhere, SNMP Broadcasters, etc) E-mail and Newsgroups Services The following actions would violate the Acceptable Use Policy when utilizing e-mail and news services through QualityEBiz.com, backbone and/or infrastructure. If e-mail or newsgroups postings are in violation of the Acceptable Use Policy, QualityEBiz.com at times may restrict or cancel subsequent postings if they affect the service. These prohibitions extend to the sending of unsolicited mass mailings or Usenet posts from another service, which in any way implicate the use of theQualityEBiz.com Hosting service, QualityEBiz.com equipment or any QualityEBiz.com e-mail address(es). Sending unsolicited commercial e-mail messages, (UCE) including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. Unsolicited e-mail is defined as e-mail that is sent to another user, who has not expressed an interest in receiving the e-mail. A user shall not send unsolicited bulk e-mail (UBE) by using any form of a commercial software or hardware mechanism for the purposes of "roadcasting" large amounts of unsolicited e-mail. A user shall not use another site's mail server to relay mail without the express permission of the site. The sending of multiple similar articles to newsgroups, and/or the sending of any amount of unsolicited e-mail messages ('Spamming') to users constitutes a violation. Users are expressly prohibited from utilizing QualityEBiz.com' service, QualityEBiz.com' equipment or any QualityEBiz.com e-mail address in connection with the sending of the same or substantially similar unsolicited e-mail message, whether commercial or not, to a large number of recipients. Legal Issues QualityEBiz.com will cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong. Activities which are in violation of any local, state or federal laws, statutes, regulations, treaties and/or tariffs would constitute a flagrant violation of the Acceptable Use Policy. Activities that are prohibited as potentially illegal include, but are not limited to the distribution, dissemination, storage, copying and/or sale of materials protected by copyright, trademark, trade secret or other intellectual-property right laws. Payment Policy QualityEBiz.com Hosting reserves the right to change fees, make plans or add services at any time. You agree to pay the fee agreed upon signing. Monthly billing is by Visa, MasterCard, Discover, American Express, PayPal,eGold, or MoneyBookers. Accounts will be canceled if they become 15 days past due. Customers are billed in US Dollars. QualityEBiz.com reserves the right to change fees without notice. This agreement will act in lieu of a signed contract for all online payment transactions. To reactivate a suspended account (due to payment problem) a $25.00 reactivation fee must be paid for each suspended account. Refund If you prepaid more than one month, the prepaid amount is not refundable unless you inform qualityebiz within 30 days of the prepaid period.(Example: if you prepaid for 90 days, you must email us whitin 30 days of the date you made payment to receive refund for the unused period) All cancellations can be received via email at sales@qualityebiz.com as per the deadlines indicated. Phone requests or any other email address will not constitute acceptance of any cancellation. Cancellation Policy Customers may cancel anytime and may do so by sending an email to sales@QualityEBiz.com. However, the cancelletion must be done within thirty days of the billing cycle. Otherwise, you will be obliged to pay the following month. We do require your name, web site address, user name, password and reason for cancellation. We will then confirm your next billing date and cancel your account on that date and remove you from billing unless a date is specified. No refund will be sent for any unused portion of a month. This provides you with time, a back up site and storage for the balance of time remaining. Once your site is scheduled to be deleted, please be sure to download all of your data as soon as possible. Once the site has been deleted, there is no way to retrieve it. All cancellations can be received via email at sales@qualityebiz.com as per the deadlines indicated. Phone requests or any other email address will not constitute acceptance of any cancellation.
